Excerpts from the minutes of the 2nd meeting of the members of the National Directorate of the League of Municipalities of the Philippines (LMP) held at the Century Park Hotel, Manila, on 08 October 2001.

ND Resolution No.05-2001

RESOLUTION OF SUPPORT TO THE DENR ADMINISTRATIVE ORDER NO. 17 SERIES OF 2001 ENTITLED DELINEATING/DELIMITING MUNICIPAL WATERS

WHEREAS, the League of Municipalities of the Philippines (LMP), during the conduct of the First Conference of Coastal Municipalities, issued Resolution No.1 series of 1999, urgently requesting the concerned national government agencies to fast track the delineation of municipal waters for the direct social and economic benefit of Philippine communities;

WHEREAS, the LMP participated actively in all the deliberations held last year conducted by the DENR-NAMRIA, DA-BFAR, DOJ, members of the academe and the civil society and was duly consulted on the final draft guidelines now espoused in DAO 17;

WHEREAS, the LMP earnestly believes that there are strong legal and technical bases supporting DAO 17 such as the Philippine Constitution, Fisheries Code of the Philippines and most especially the Local Government Code of the Philippines;

WHEREAS, LMP recognizes the potential economic benefit of the delineation of municipal waters to coastal municipalities and non-coastal municipalities in its peripheries out of an improved management of municipal waters;

NOW THEREFORE, premises considered and upon motion en masse,

BE IT RESOLVED AS IT IS HEREBY RESOLVED that the League of Municipalities of the Philippines, represented by the National Directorate, reaffirms and makes public its full and uncompromising support to the DENR DAO 17;

RESOLVED FURTHER that the LMP enjoins local government units at all levels to be united with the organization in this declaration in the spirit of genuine autonomy;

RESOLVED FURTHER that the LMP requests the Department of Justice to render its legal opinion based on the most transparent and liberal interpretation of Philippine laws;

RESOLVED FURTHER that the LMP requests the appropriate national government agencies to allocate and whenever necessary, realign their budgets to support municipal LGU’s coastal management programs;

RESOLVED FURTHER that the LMP requests the appropriate Committees of both Houses of Congress to legislate measures that will further enhance local government’s proprietary rights over municipal waters in support of the government’s food security and poverty alleviation program;

RESOLVED FINALLY that copies of this resolution be forwarded to the Office of the President, Offices of the DENR Secretary, DA Secretary, BFAR Director and other offices concerned for their information and appropriate actions.

UNANIMOUSLY APPROVED.
